ORDER NO.E2-342/2009 DATED : 23.04.2010

As per GO under reference 1 & 2 Government have regulated the guide lines/norms for the transfer and posting of employees working in the departments under the Local Self Government Department. It has been ordered interalia, in the said GO that General Transfers will be made once in a year during April/May. As per reference 4th cited it has modified it as 15th March every year.

As per the reference 5 a draft order of transfer and posting of U.D.Clerks working in this district and the 10 U.D.Cleks allotted by the Director of Panchayats was published and as per reference No.6 18 Nos. of U.D.Clerks were allotted from various districts to this district for giving them suitable appointment.

In the above circumstances, the following UD Clerks noted in the column 1 are provisionally transferred and posted in stations noted in column II as per the conditions stipulated in GO cited as reference 1 & 2 and hence finalising ref.No.5 as follows.

Read:- Letter No.E12-30810/04 dated 04-11-2008 from the Director of Panchayats, Thiruvananthapuram

ORDER

During Post-decentralization the financial workload of village panchayats has increased manifold. Due to this pressure of work the accounting system is under severe strain. This has been pointed out several times by the Accountant General.The third Financial Commission has recommended the setting up of a Finance and Accounts wing in all Local Governments. Thought computerisation part of the workload could be absolved. But there is still need for additional manpower.

Government have examined the matter and considering the need for additional manpower till the Accounting Cadre is put in place are pleased to accord sanction, as in interim arrangement, for the creation of one temporary post each of Accountant on Rs.8390-13270 in the Grama Panchayats. These posts will be filled up by promotion of Upper Division Clerks in the Grama Panchayats subject to the following conditions.

The newly posted Accountants would be given one month induction training including hands - on-training on use of computers.
Those promoted, as Accountants will be retained as Accountants for a minimum period of three years except, of course, in case of promotion.
Computerisation of PRI accounts will be initiated along with this process.
In those Grama Panchayats, which already have Junior Superintendent and Head Clerk posts, new posts of Accountants would not be created.

In 18 such Grama Panchayats the Head Clerk post will be re designated as Accountant posts. There are 642 Grama Panchayats where the staff strength is 10 and above, including re-deployed staff, in such Panchayats, to reduce the financial burden due to the creation of new post, one of the existing post of Upper Division Clerk will be upgraded to the Accountant. In 339 Grama Panchayats where the staff strength is below 10, a post of Accountant will be created.

The post of Accountant is equated to that of Head Clerk in the scale of pay of Rs.8390-13270. The additional expenditure due to the post creation would be absorbed by the village panchayat themselves from their own fund / General Purpose Fund.

Broad band Internet connectivity under USO

The department of Telecommunications has implemented USO (Universal Service Obligation) under which Broad band Internet connectivity is being facilitated in all the villages in India. Under the scheme BSNL shall connect Govt.offices, community centres, Health centres, Panchayats and Police stations in 873 rural exchanges in kerala at subsidised rates under two subsidised plans as below

1.USO plan 99 Rs.99/per month 400Mb download limit

2.USO plan 150 Rs.150/ per month 1GB "

512 Kbs brand width : additional data download @Rs.0.40/Mb. No modem rent

Panchayat offices located under these rural exchanges are advised to utilised the benefit of the scheme by subscribing to one of the plans. The scheme is to end by 30th June 2009. A minimum of six Govt.offices per exchange may avail of this scheme.

ORDER

As per the letter read as 1st paper above, directions has been issued to deduct the dues of water charges to Kerala Water Authority from the General Purpose Grant/ Maintenance Expenditure(Non-road). As per the letter read as 2nd paper above, Director of panchayats has reported that an amount of Rs 16,90,08,159/-(Sixteen Crores Ninety Lakhs Eight Thousand One Hundred and Fifty nine rupees only) has been deducted as water charges from the General purpose grant of 632 Grama panchayats of the state from the 9th and 10th instalment of release and remitted to KWA by way of DD. Now, most of the Grama panchayats have prepared projects for the remittance of water charges from the Maintenance Expenditure(Non-road) and requested to reimburse the amount from the General Purpose Grant. Therefore , Director of Panchayats has requested the Government to issue necessary directions to clear all water charges from the Maintenance Expenditure (Non-road) subject to the condition that the amount deducted from the General Purpose Grant will be reimbursed.
Government have examined the matter in detail and are pleased to accord sanction to remit the water charges from Maintenance Expenditure (Non-road) to those willing Grama Panchayats directly to the kerala Water Authority and Managing Director, Kerala Water Authority will in return refund the amount already deducted and remitted from the General Purpose Grant Panchayts by Director of panchayats, Thiruvananthapuram, to the Grama Panchayts concerned.

The Candidates advised by the District Officer Kerala Public Service Commission, Kollam for appointment as L D Clerks in Panchayat Subordinate Service in Kollam District are provisionally appointed as L D Clerks in the scale Pay of Rs 5250-8390 under Rule 9(a) (1) of K S &SSR , 1958 and under Kerala Panchayat Subordinate Service Rules 1994 subject to the verification of age, date of birth and qualifications etc . with original certificates to be produced by the candidates at the time of joining duty. The advice of the candidates is subject to Rule 3(c) of General Rules of KS&SSR , 1958.
The appointment of the candidate is subject to the conditions that it shall be terminated without notice if Government are not satisfied of their character and antecedents on subsequent verifications and they will be eligible for appointment in regular service in accordance with rules only if their character and antecedents are found satisfactory . They will be on probation for a total period of two years within a continuous period of three years from the date of joining duty during which they should pass M.O.P.Test The candidate appointed should report for duty before the Secretaries of Grama Panchayats concerned within 15 days from the date of receipt of this order, failing which the appointment shall be cancelled without any further notice. The candidates appointed should produce a physical fitness certificate obtained from a Medical Officer not below the rank of a Civil Surgeon in Government service at the time of joining duty. If the Candidates has to apply for correction of date of birth in the Service Book if any needed shall be made within five years from the date of entry in service as per the provisions contained in the G.O (P) No 45/91/P&ARD dated 30/12/91. In the event of discharge from the service for want of vacancies, they may either re- register their name in the office of the Public Service Commission from where they are advised and get themselves re-appointed on further advice by the Public Service Commission or they may wait for their turn for re-appointment to the department in case they desire to continue as probationer in the post from which they were discharged.

The Secretaries of Grama Panchayats concerned should obtain a declaration from the candidates to the effect that they are willing to do the collection work in the respective Panchayat area . The Secretary should verify the date of birth and qualifications etc . of the candidate with original certificates to be produced by the candidates at the time of joining duty . The Secretary should also obtain and forward to this office the enclosed proforma duly filled in by the candidates before they are allowed to join duty . The identification certificates of the candidates are also enclosed herewith for verification and for pasting that in the Service Book of the candidates . The Secretaries of Grama Panchayats concerned should also make necessary entries regarding the quota in which the person is appointed in the Service Book of the Candidates.

The Secretary should also verify the Non-Creamy Layer certificate and Community Certificates issued by the competent authorities to satisfy himself that the Candidates in Sl Nos 1 to 4 do not belong to the category of the Creamy Layer.

The date of joining duty of the Candidates should be reported to this office without
fail.

S.R.O.No. 495/2007 – In exercise of the powers conferred by subsection (1) of section 274 of the Kerala Panchayat Raj Act, 1994(13 of 1994) and in super-session of all the previous notifications issued in this subject matter, the Government of Kerala hereby declare that those provisions of the Kerala Municipality Act, 1994(20 of 1994) mentioned in the Schedule below and the Kerala Municipality Building Rules, 1999, shall be extended and be in force in all the Village Panchayats of Kerala State with immediate effect.

Explanatory Note

Kerala has a unique environmental situation, which has historically influenced the human settlement as well as land use pattern. However, of late, large scale development
Is taking place in unregulated manner even in the rural areas of the State
This rapid growth in an unplanned manner without reference to the carrying capacity of a locality in relation to available infrastructure, services and resources would have serious negative consequences affecting the present and future development of the State. Therefore it is necessary to ensure proper regulation of development especially construction activities. For this purpose Government have already implemented the provisions of Kerala Municipality Building Rules and the relevant provisions of the Kerala Municipality Act, 1994 (Act 20 of 1994) in 184 Panchayats. Now it is decided to extend the application of the Kerala Municipality Building Rules, 1999 and the relevant provisions of the Kerala Municipality Act, 1994(20 of 1994) to all village Panchayats of Kerala State.
This notification is intended to achieve the above object.

As per the Government Order read as first paper above, sanction has been accorded to all Government Departments and Public Sector Undertakings etc to effect the purchase of textile goods for their requirements from M/s Hantex & M/s Hanveev without resorting to tender formalities in relaxation of para 57(a)(i) of store purchase Manual till 31.3.07. As the validity period of the Government Order read as 1st paper above has beeb ended, the President and Chairman, M/s Hantes and M/sHanveev as per their letters read as second and third paper above has requested to extend the validity period for a further period of one year from 1.4.07

Government has examined the matter in detail and are pleased to accord sanction to all Government Department/Public Sector undertaking etc to effect direct purchase of textile goods for their requirements from M/s Hantex and M/s Hanveev without resorting to tender formalities in relaxation of para 57(a)(i) of Store Purchase Manual for a period of six months from1.4.2007 on condition that further extension in this order will be granted only after fixing the price of the textile goods by a Price Fixation Committee.
